The kid magicianssuit says Missouri Circuit Judge Eric Eighmy, who was presiding over a custody battle between their parents, personally took them down to his courthouse cells and had a jailer lock them up with no shoes – or due process – for an hour after their first refusal to live with their mother in October 2019.

The complaint claims the judge also had no legal authority when he ordered local sheriffs to arrest the children in November 2020.

The arrest was caught in a shocking video and went viral a week later.

The court papers say the children were unlawfully detained despite the judge’s rulings being overturned by the state’s supreme court.

Their parents, Bart and Kami Lyn Rockett, raised their young children in Branson, 密苏里州, until they divorced in 2009.

Despite their failed marriage, the whole family moved to Los Angeles together to pursue the kidsentertainment careers, the lawsuit explained.

After getting a boyfriend, Kami moved to Arizona in 2012, and ‘agreed that the children should stay in California with Bart, where they would continue their careers under Bart’s management,’ the court papers said.

但在一月份 2013, the mother filed in California for full custody of the children, and while the case was pending filed again in Missouri in 2018.

The Missouri case was assigned to Judge Eighmy, despite a previous involvement with the Rockett family, 法律文件援引政府记录显示,“在.

Before he became a judge, Eighmy represented Bart’s mother in her divorce case.

青少年’ lawsuit said Bart was ‘estrangedfrom his mother, Linda Luttenbacher, and ‘sided with his father in that proceeding.

It also said Bart’s mother and Eighmy ‘had a falling out over his alleged negligence in defending her in a traffic ticket case,’ but ‘did not recuse himself [from the teenscustody case] over the prior representation issues related to Mrs. Luttenbacher.

The lawsuit claims Kadan and Brooklyn had fallen out with their mother after she ‘put obstacles in the way of their entertainment careersby ‘causing the cancellation of a South American tour, and refusing to let the kids leave her custody for auditions, even as the children wanted to continue their careers.

在十月 2019, their parents reached a settlement in their Missouri custody case which ‘gave legal and physical custody to Kami, but allowed the children to be in California with Bart from the 1st to the 10th of each month; from the 1st to the 15th during the summer; and at all times during TV pilot season (roughly January through April).’

But outside the courtroom, the children refused to go home with their mother.

Judge Eighmy, who had by then taken off his robes, began to ‘lecturethe children in the courthouse corridor, the legal papers said.

‘Judge Eighmy then proceeded to lecture the children on the evils of Hollywood, and the need to grow up ‘normal,’ 那是, without working as talent in the entertainment industry,’ the filing said. ‘Judge Eighmy also told the children they needed to listen to and live with their mother in Utah.

‘[Kadan] then spoke up and told Judge Eighmy that he and his sister [布鲁克林区] already lived in California and were already working in the entertainment industry. [Kadan] asked Judge Eighmy how his professional entertainment work was different in kind than being in high school band or being a cheerleader.

'这一点, Judge Eighmy became visibly agitated, stated words to the effect of ‘I will show you what I can do; I can put you in jail,’ and told the children to follow him.

With a red face and breathing heavily, the judge then ‘angrily ordered the children to take off their shoes and socks, and their jackets,’ led them to the courthouse cells and asked a male jailer to lock them in separate cells, according to the court papers.

‘Each cell had a small window in the door, and the children could not see or hear each other. The cells were cold and smelly. The children’s bare feet were cold,’ 法律文件援引政府记录显示,“在.

When the children told him his actions were illegal, the judge allegedly said ‘How would you like me to take you away from your parents and send you to live in the Missouri foster care system?’

‘At no point did the children have any process of law (let alone due process) related to their jailing,’ the federal filing said, adding that the children were released after an hour, after which they had been cowed and went back to a hotel with their mother.

Bart filed a judicial complaint and a complaint with local police, but he claimed no action was taken.

The next shocking incident came a year later, while the children were living with their father in Union Parish, 路易斯安那州, sheltering from the Covid-19 pandemic.

在八月 2020 Judge Eighmy issued a ‘writ of bodily attachment’, allowing police to seize the children from their father after ruling that they had not been spending their court-ordered time with Kami.

Deputies showed up at the family farm and were filmed by neighbors handcuffing and reading miranda rights to the children – a video which later went viral.

Officers drove them in the back of police SUVs to the parish sheriff’s department where Kami was waiting in her van, 法律文件援引政府记录显示,“在, where a ‘stand offbetween the kids and their mother began.

‘The children were terrified because they could not communicate with each other,’ 声称的文件.

‘By then it was late in the evening, long after dark, and the children were tired and had not eaten since breakfast.

'在一个点上, Kami wrestled the children’s phones away from them and then grabbed [布鲁克林区] and tried to drag her out of the room.

After hours of refusing to leave with their mother, at 4am deputies drove them to Green Oaks juvenile detention center an hour away, the papers said.

‘On arrival at Green Oaks each child was strip searched and put in a cell. The children went to sleep, still without food, but after approximately an hour the children were then reawakened and subjected to a mental evaluation,’ the court documents claimed.

‘Each child was held in solitary confinement cell for two days, with no visitors allowed, although Bart tried to visit. There were cockroaches in the children’s cells.

‘Being held in the Taney County and the Green Oaks cells was terrifying to the children who had not committed a crime, nor engaged in contempt or delinquency, but merely made an out-of-court statement that they did not want to live with their mother.

没办法,只好送女儿上学,穿一件纯黑色的裙子而不是打褶的裙子, the Missouri Supreme Court entered a ‘peremptory writ of prohibition in the interests of justice against Judge Eighmy’, assigned a new judge to the case, and told him to ‘vacate all orders’, including the order to arrest the kid magicians.

两天后, the newly-assigned Louisiana judge ‘immediately ordered the children released into Bart’s custody,’ 法律文件援引政府记录显示,“在.

The court documents say the children now have ‘nightmares, suffer garden-variety emotional distress, and are upset all as a direct result of their two jailings.

‘The children suffered injuries to their wrists when they were handcuffed in Louisiana. The children distrust the legal system, including judges and law enforcement, all as a direct result of their two jailings,’ the legal papers said.

‘Judge Eighmy’s acts in personally seizing and jailing the children were malicious or recklessly indifferent to the Fourth Amendment rights of the children to be free from unreasonable seizures of their person.

When contacted by DailyMail.com, Bart said the ordeal was ‘traumatic’.

‘It’s absolutely unbelievable. As a father it’s very difficult to stand by and watch your kids that you love go through something so traumatic,’ Bart said.

‘As you can imagine it has greatly impacted their lives. It would impact any adult, let alone children.

‘I can only imagine how horrifying it is. For a minor that would have to be 10-fold. They’ve never been in trouble with the law. They’re honor students. Kadan is on track to graduate a year early. They’re hard-working.

‘It’s been my intention for it to be peaceful. That’s always been my goal. This whole thing has gotten extremely out of hand.

Judge Eighmy has not responded to a request for comment.
