    Shocked Dan Kitchener was sat behind in stop-start traffic near Swanscombe in Kent when he spotted the X-rated images.

    The father-of-one could see the adult content on the screen through the back window of the 70-plate vehicle.

    What are the rules on using a phone or sat nav while driving in the UK?

    Under UK rules it is illegal to hold a phone or sat nav while driving or riding a motorcycle.

    The only time you can use a hand-held phone in a car is if you are safely parked or need to call 999 of 112 in an emergency and it’s unsafe or impractical to stop.

    But you can use a hands-free device, so long as it does not block your view of the road and so long as you remain in control of your vehicle.

    A hands free device includes a Bluetooth headset or a device controlled by voice command and it must be secured via a dashboard holder, a windscreen mount or be a built-in sat nav device.

    The law still applies even if you are stopped at traffic lights, queuing in traffic or supervising a learner driver.

    Those who break the rules can get six points on their licence and a £200 fine.

    For those caught within two years of passing their driving test, the penalty is an automatic loss of their licence.

    Particularly egregious cases can end up in court where financial penalties can be as high as £1,000or £2,500 for those in larger vehicles such as buses or lorries.

    Those who have a hands-free device but have an obstructed view can still get three penalty points.

    Driving rules around use of touch screens in the UK are being updated by the Government.

    When the legislation outlawing mobile phone use in cars arrived in 2003, handheld use was out, but hands-free access was allowed.

    Tans, drivers are banned from texting or making a phone call on a handheld device, unless in an emergency.

    But in November the Government announced that, from this year, the rules will be extended to cover scrolling through playlists, taking photos or videos, and playing games on phones when driving.

    The Highway Code will also be revised to make it clear that being stationary in traffic counts as driving, and that using a handheld phone at traffic lights or in motorway jams is illegal except in limited circumstances.

    Drivers can still use devices for satellite navigation, if they are secured in a cradle.

    But as a catch-all clause, motorists must take responsibility for their driving and can be prosecuted if the police find them to not be in proper control of their vehicle.

    Road safety charity the Royal Society for the Prevention of Accidents (Rospa) meanwhile says that in 2019, ‘distraction inside vehiclewas cited as the contributory factor in 2,563 road traffic accidents — 65 of which were fatal.

    It has highlighted infotainment systems as a key issue, sê, ‘While these can be handy for the driver, allowing them to carry out many tasks, they could also be a distraction.

    Rospa adds: ‘People often do not realise when they are cognitively distracted, such as during a mobile phone conversation.

    ‘Rather than scanning for hazards, they spend more time staring ahead than usual, leading to tunnel vision.

    Previously it was only possible to play videos and games on the touchscreen when a Tesla car was parked.
